Kenya's Mining Act, 2016 represents a significant overhaul of the country's mineral resources regulatory framework. The Act, which repealed the Mining Act (Cap. 306), introduces a new licensing regime, clearer royalty structures, and enhanced community benefit-sharing mechanisms that all mining investors must understand.
The Act establishes a consolidated mineral licensing regime comprising reconnaissance licences, prospecting licences, retention licences, and mining licences. Each licence type carries distinct rights, obligations, and duration requirements, making it essential for investors to select the appropriate permit for their stage of exploration or extraction.
Community benefit-sharing is a cornerstone of the new regime. The Act requires mining companies to allocate a percentage of their annual royalties to community development funds, ensuring that host communities receive tangible economic benefits from resource extraction activities within their areas.
Environmental compliance provisions have been substantially strengthened. Mining licence holders are required to prepare and submit Environmental and Social Impact Assessments (ESIAs) and implement approved Environmental Management Plans throughout the licence period. Failure to comply can result in suspension or revocation of the mining licence.
For foreign investors, the Act provides pathways for participation while maintaining requirements for local content, training of Kenyan personnel, and preferential procurement of local goods and services where feasible.
The Directorate of Mines, operating under the Cabinet Secretary for Mining, is the primary regulatory authority. Investors must engage proactively with the Directorate and relevant county governments to ensure smooth licensing and operational compliance.
